Homeless Still Have Rights to Property Left Unattended
Nine homeless residents of Skid Row sued the city for violations of their Fourth and 14th Amendment rights after police confiscated the property they left on the sidewalk. They say their legal papers, family pictures and other possessions were immediately destroyed.
Skid Row in downtown Los Angeles is home to one of the nation's largest homeless populations. The men and women who dwell there say they left their property unattended but not abandoned while eating, showering or using the bathroom.

Scalia: Women Don't Have Constitutional Protection Against Discrimination
WASHINGTON -- The equal protection clause of the 14th Amendment to the U.S. Constitution does not protect against discrimination on the basis of gender or sexual orientation, according to Supreme Court Justice Antonin Scalia.
In a newly published interview in the legal magazine California Lawyer, Scalia said that while the Constitution does not disallow the passage of legislation outlawing such discrimination, it doesn't itself outlaw that behavior:
In 1868, when the 39th Congress was debating and ultimately proposing the 14th Amendment, I don't think anybody would have thought that equal protection applied to sex discrimination, or certainly not to sexual orientation. So does that mean that we've gone off in error by applying the 14th Amendment to both?

Justices debate Chicago handgun ban

Washington (CNN) -- Chicago's 28-year-old strict ban on handgun ownership appeared in trouble Tuesday at the U.S. Supreme Court in a potentially far-reaching case over the ability of state and local governments to enforce limits on weapons.
A conservative majority seemed ready to say the U.S. Constitution gives individuals greater power than states -- or at least equal power -- as far as possessing certain firearms for self-protection.
The only question was how far the court would apply competing parts of the 14th Amendment to preserve some "reasonable" gun control measures in place nationwide.
